Periodic Inspections, Water Bills, and Expired Smoke Alarms

These landlords, a family made mostly of Karens, think that they can do whatever they want, since they own the property. The space that you pay rent for is for your sole use. You have the right to quiet enjoyment of that space.

Quiet Enjoyment

Unlike in many other states, a California landlord does not have the statutory right to perform periodic inspections. They must put this in the lease, if they want it. They have not done so. The landlords can only enter to perform necessary maintenance and repairs. Inspections for leaks are not that. Inspections for your housekeeping habits is not that. Pushing buttons on a smoke alarm is not necessary maintenance if they ignore that the smoke alarm has expired and ignore that the smoke alarm has batteries in it over two years old. You have the right to quiet enjoyment of your home.

Safe and Habitable

California landlords have a duty to maintain their rental properties in a condition that is safe and habitable. This includes ensuring that they are free from conditions that could endanger health or safety of the occupants. An apartment with an expired smoke alarm or missing a carbon monoxide detector is not habitable. Once the landlord is notified of the inhabitability, they cannot collect rent until the apartment is made habitable again. Rocklin Code Enforcement can enforce these violations. Water Billing

A California landlord can not charge for water unless each apartment unit has its own water meter. Instead, the landlord must include the water utility service as part of rent. If a landlord has submeters for each unit, then they must only bill you for the amount of water that you use and recurring fixed charges proportionally allocated to the tenants. If you are paying for water separately, then this means there are water meters. Your monthly water can’t always be the same unless water usage does not change month to month. Something super fishy is going on .

Visible Mold

Sound Dampening/Insulation

Infestation of insects or vermin
